Privacy Notices

Why do privacy notices need to be issued?

The Data Protection Act 1998 has put in place numerous safeguards regarding the use of personal data by organisations, including the Department of Education, local authorities and schools. This area of law is complex. The Act gives rights to those about whom data is held, known as data subjects. This includes:


• the right to know the types of data being held
• why it is being held, and
• to whom it may be communicated.


Privacy notices are designed to meet those needs of the Act and should be brought to the attention of all pupils for whom data is being submitted in the School Census. Schools and local authorities are responsible for doing this for their pupils and the privacy notice might be included as part of an induction pack, and/or posted on the staff noticeboard/intranet.

From 25th May 2018, the existing 1998 Data Protection Act (DPA) will be replaced by the new Data Protection Act 2017, also known as the General Data Protection Regulation or GDPR.

The Department for Education (DfE) has issued a revised model Privacy Notice for schools to use and this is available for download below. The red text within the document requires your specific school details. Please note it is not necessary to reissue Privacy Notices to pupils who received the previous version. However, please be aware that any hard copies available in public places, for example, notice boards should be kept up to date.

The DfE has also recently issued a toolkit to help schools with compliance with GDPR and this is available for download below.
